Mix Feelings

Post by solitario11 »

I have mix feeling about the following new law in NYS
I am guilty of this 2x, dint know about being a class D anything. In my case I just made as if I dint see the cop and ignore as I haul a$$. both time the cop was facing opposite the way I was going.

The Trooper Craig Todeschini Law (Flight from LEO)

New York State Governor George Pataki has just signed into law the "Trooper
Craig Todeschini Law", named after Trooper Craig Todeschini, who died on April
23, 2006 when he crashed into a tree while pursuing a motorcyclist at more than
100 mph in Pompey, Onondaga County.

The law, which took effect November 4, 2006, changed the classification for
fleeing from a police officer from a violation to either a felony or a
misdemeanor, depending on the degree.

Fleeing a police officer in the first degree is now classified as a class-D
felony; it is a class-E felony in the second degree; and in the third degree it
is considered a class-A misdemeanor.

Laws like that are on the books to try to prevent people from fleeing the police and endangering themselves, others and the officer. Oregon has the same type of law except its much simplier, attempt to elude an officer and it's a class C felony. You can go to jail for over a year, you will loose your license and your vehicle will be seized, not just towed, but seized. In my jurisdiction that means the normal $100 some tow bill becomes over $900 as soon as the tow touches the car, truck, bike etc. The first offense you are able to pay the fee and get the vehicle back. The second offense, they put a lean on the car and sell it while you get nothing. Its much easier and safer to pull over and take the ticket.
